When a sailor is injured or a maritime worker is injured or when a crew injury occurs, a vessel owner and its marine insurer like to use to the Limitation of Liability Act to prevent recovery by the injured person. This isn't fair. John Fulweiler has a lot of success defeating the Act and had recently written an article for the Rhode Island Bar Journal about the Act.
